DECISION TO BE HANDED DOWN IN PEACE RIVER
Blair Bush’s trial was held in Falher Provincial Court on November 1.
Bush faces one charge of impaired driving and one charge of driving with a blood alcohol level over .08.
The Crown called three witnesses to testify and the defence counsel cross-examined each one.
The issue of a voir dire – a preliminary examination to determine the competency of a witness or juror – came up with one of the witness’ testimony, and the defence counsel also raised a Charter of Rights issue regarding the defendant.
The defendant was not called to testify.
Judge Rob Marceau said he will consider all the matters and hand down his decision in Peace River Provincial Court on December 7.

FINES FOR DRIVING WHILE DISQUALIFIED
Frederick Sutherland pled guilty to one charge of driving a motor vehicle while disqualified. Sutherland received a $310 fine.
Richard Wagner pled guilty to one charge of driving a motor vehicle while disqualified. Wagner received a $300 fine and a $45 surcharge.

CHARGE WITHDRAWN
The Crown dropped a charge of exceeding the maximum speed limit against Iain Alexander Smith.

ARREST WARRANT ISSUED
Judge Rob Marceau issued a warrant for the arrest of Myrna Frances Cardinal. She did not appear in court and is facing one charge of driving a motor vehicle without insurance.

CASES DEFERRED
Ryan Smith appeared by CCTV from the Edmonton Remand Centre. His case was deferred to November 5 in Peace Provincial Court. Smith has 14 charges, including a new charge of failing to attend court on August 16.
Beverly Kaye Lambert’s case has been held over to December 6 in Falher Provincial Court, for plea. She faces one charge of assault and one charge of uttering a threat to cause bodily harm.
Glen Mandelin’s case has been deferred to December 6 in Falher Provincial Court. He faces one charge of assault.
Clarence Payou’s case has been deferred to December 6 in Falher Provincial Court. Payou is seeking Legal Aid and he faces seven charges, including one charge of impaired operation of a motor vehicle, one charge of driving with a blood alcohol over .08, one charge of dangerous operation of a motor vehicle, one charge of driving while disqualified, one charge of possession of stolen property, one charge of theft of a motor vehicle and one charge of theft under $5,000.
Boyd Romanko’s case has been held over to December 6 in Falher Provincial Court. Romanko faces one charge of impaired driving and one charge of failing to provide a breath sample.
Moyano Florez’s case has been held over to December 6 in Falher Provincial Court. Florez faces four charges, including one charge of exceeding the maximum speed limit, one charge of driving while disqualified, one charge of driving a motor vehicle without insurance and one charge of operating an unregistered motor vehicle.
The Bobby Hnatko/Western Air Spray Inc. case has been transferred to Slave Lake Provincial Court, which will be heard on December 12. The parties in the case face several charges, which includes providing false information and continuing/commencing operations that were not permitted.
Tyler James Williams appeared by CCTV from the Peace River Correctional Centre. He has pled not guilty to all charges and his case is set for trial in Falher on February 7, 2019. He has seven charges, including two charges for assault and one for assault with a weapon.
Jeffrey Joseph Burback’s case is set for trial in Falher Provincial Court on April 4, 2019. He has pled not guilty to his two charges, including one for unauthorized possession and one charge of failing to appear in court.
Mathew David Schultz’s case is set for trial on March 21, 2019. He has pled not guilty to one charge of impaired driving and one charge of driving with a blood alcohol level over .08.
Lee Smith’s case is set for trial on March 21, 2019 in Falher Provincial Court. Smith has pled not guilty to one charge of exceeding the maximum speed limit.
Darrell Fiddick’s case is set for trial on May 2, 2019 in Falher Provincial Court. He pled not guilty to one charge of impaired driving and one charge of failing to provide a breath sample.
John Martin Irwin’s case is set for trial in Falher on June 6, 2019. He has pled not guilty to 19 charges of fraud.
Aciff Williams’ case is set for trial July 4, 2019. Williams faces a charge of impaired operation of a motor vehicle, one charge of driving with a blood alcohol level over .08 and one charge of dangerous operation of a motor vehicle.

ORDERS OF FORFEITURE
Judge Rob Marceau issued three orders of forfeiture for unknown persons, as requested by the Crown.
The judge also issued forfeiture of several clothing items from Aaron Beauregard.
